Terms of Service

Effective

These Terms of Service govern your access to and use of Mokly Cloud.

Mokly is provided by Calum Moore Consulting Limited, a company registered in England and Wales with company number 09018453 and registered office at 26 John Hogan V C Road, Manchester, England, M40 7QU.

You can contact us at [email protected].

1. What Mokly does

Mokly helps teams publish, browse, compare and share React-authored mockups connected to Git repositories, branches and pull requests. The hosted service can receive generated catalogues, control access to them and report publication results to connected services such as GitHub.

Your repository remains the source of truth. You are responsible for:

The open-source Mokly CLI is distributed separately under its published MIT license. These terms apply to Mokly Cloud and do not replace the license for open-source software you install or run yourself.

2. Who may use Mokly

You may use Mokly if you are at least 18 years old and able to enter into a binding agreement. If you use Mokly for a company or another organization, you confirm that you have authority to accept these terms for that organization.

You must provide accurate account, organization and contact information and keep it up to date.

3. Accounts and security

Mokly supports email magic links and GitHub sign-in. You are responsible for protecting your email account, GitHub account, devices, sessions, invitations and publishing tokens, and for activity carried out through access you grant.

Invite only people who are authorized to see the relevant organization, project and catalogue content. Review access when a team member changes role or leaves. Tell us promptly at [email protected] if you believe an account, session, invitation, token or integration has been compromised.

4. Customer content

You keep ownership of the repositories, generated catalogues, screens, assets, project details, organization details and other content that you or your users submit to Mokly.

You give us a worldwide, non-exclusive right to host, copy, process, transmit, display and back up that content only as needed to provide, secure, support and maintain Mokly. This right ends when the content is deleted from our systems, subject to the retention described in our Privacy Policy.

You control whether a project is public or private. Content published through a public project may be available without signing in. You are responsible for checking visibility before publishing and for ensuring that you have the rights and permissions needed to upload, process and share the content.

We do not sell customer content.

5. Acceptable use

You must not:

We may restrict or suspend access where we reasonably believe these terms have been breached, a security risk exists or action is needed to protect users, the service, a third party or the law.

6. GitHub and other services

Mokly can connect to GitHub for authentication, repository access, pull request information, checks and related workflows. It also depends on providers for hosting, storage, content delivery and service email.

Third-party services have their own terms and privacy notices. We are not responsible for a third-party service outside our control, but we use reasonable care when selecting providers that operate Mokly.

You are responsible for configuring third-party access and permissions that you control. Removing or restricting an integration may stop the affected Mokly feature from working.

7. Service availability and changes

We aim to provide a reliable service, but maintenance, upgrades, faults, security incidents, internet failures, provider outages or events outside our reasonable control may interrupt access.

We may add, change, suspend or remove features. Preview, beta, experimental and early-access features may be incomplete, change without notice or be withdrawn. Where practical, we will give reasonable notice of a material change that substantially reduces the service.

8. Security

We use technical and organizational measures designed to protect Mokly and customer data. Our Security page describes the current controls and how to report a concern.

No online service can guarantee perfect security. You must keep your devices, email and GitHub accounts, sessions, invitations, tokens and team access secure.

If you discover a security issue, contact [email protected]. Do not exploit the issue, access other customers’ data, disrupt the service or publish details before we have had a reasonable opportunity to investigate and respond.

9. Intellectual property and open-source software

We and our licensors own the hosted Mokly service, its product design, documentation, trademarks and other intellectual property, excluding customer content and separately licensed open-source software.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use Mokly Cloud for your own or your organization’s design workflow. You may not resell, sublicense or commercially exploit the hosted service unless we agree in writing.

Open-source components remain governed by their own licenses. Nothing in these terms limits rights granted by those licenses.

10. Confidentiality

Each party may receive confidential information from the other. The receiving party must protect it with reasonable care and use it only for purposes connected with Mokly. This duty does not apply to information that is public through no breach, was already lawfully known, is received lawfully from another source or must be disclosed by law.

11. Disclaimers

We provide Mokly with reasonable skill and care. So far as the law permits, we do not promise that:

Review Mokly’s output before using it to make product, engineering, security, legal or business decisions.

12. Liability

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or applicable statutory rights.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, anticipated savings or business opportunity. We are also not liable for loss caused by customer content, an unauthorized configuration or a third-party service outside our reasonable control.

For a paid service, our total liability arising out of or connected with Mokly is limited to the fees you paid for that service in the 12 months before the event giving rise to the claim. For a free service, preview feature or unpaid trial, our total liability is limited to GBP 100.

These limits apply whether a claim is in contract, tort, negligence, breach of statutory duty or otherwise, so far as the law permits.

13. Ending access

You may stop using Mokly at any time. You can remove team access, revoke publishing tokens and delete projects or organizations using the controls available in the service.

We may suspend or terminate access if you materially breach these terms, create a security or legal risk or use the service in a way that could harm Mokly, another user or a third party.

After access ends, we may retain or delete data in line with our Privacy Policy, backup schedules and legal obligations. Keep your own repository and any exports you need before ending access.

14. Changes to these terms

We may update these terms as Mokly, our providers or legal requirements change. If a change is material, we will take reasonable steps to notify affected users, such as by email or an in-product notice.

If you continue using Mokly after updated terms take effect, you accept the updated terms. If you do not agree, stop using the service before that date.

15. Governing law and disputes

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

Before starting legal proceedings, please contact us so we can try to resolve the issue. Our Complaints page explains how to make a complaint.
